Oxfordshire Railfreight Limited – Strategic Rail Freight Interchange Privacy Notice

This is privacy notice is in respect of Oxfordshire Railfreight Limited’s proposal for a Strategic Rail Freight Interchange (“SFRI”) on land east of the former Upper Heyford Air Base, south of the Chiltern railway line, and southwest of Junction 10 of the M40 motorway (“Proposed Development”). Details of the current proposals can be found online at https://oxsrfi.co.uk/.

The Proposed Development will be the subject of an application to the Secretary of State for a Development Consent Order (“DCO”).

Who are we and further information

For the purposes of UK data protection laws, Oxfordshire Railfreight Limited (“we”, “our” and “us”) are the controller of the personal data processed as described in this privacy notice. That means we are responsible for deciding how and why your personal data is processed. Oxfordshire Railfreight Limited are a special purpose vehicle set up by Mountpark Logistics EU Sarl (“Mountpark”), part of the Mountpark Group, to promote and develop the Proposed Development.

It is important that you read this privacy notice together with Mountpark Group’s privacy notice available at https://mountpark.com/privacy/ which contains more information about how we process your personal information. Oxfordshire Railfreight Limited is the relevant Mountpark entity referred to in that privacy notice that is the controller of your personal data.

How and why we collect your personal information

We collect some of your personal information from our direct interactions with you. However, we receive most information from third parties including TerraQuest Solutions Limited “TerraQuest” and our agent, Ardent Management Limited (“Ardent”). We may also receive your information from individuals who share this with us with your permission.

TerraQuest is working on behalf of Oxfordshire Railfreight Limited in respect of the Proposed Development and the proposed DCO application. We have appointed TerraQuest to provide land referencing services and in particular to gather and verify who has legal interest and rights over the affected land, in order to assess who may be impacted by the Proposed Development.

Ardent is instructed as our land agent to engage with landowners and third parties to seek voluntary arrangements where interests in land are required for the Proposed Development.

What personal information do we collect about you?

The personal information we may collect about you is listed below so you can see what we may know about you.

  • Identity information: information that identifies who you are, such as your name and current address
  • Contact details: information that can be used to contact you, such as your phone number and email address
  • Property information: information about ownership and occupation of land and property, such as whether you are a tenant, owner or occupier of land on which the Proposed Development is to be built, and details of any interests in or rights over property or land.
  • Business information: information about businesses which own, operate from, use or have a legal interest in the land/property, including address, phone numbers and details of individuals and partners, trustees, governors or similar executive positions (such as full names, addresses and telephone numbers).

How do we use your personal information and our legal basis?

We collect this information so that all parties with an interest in the land, including those who may have rights over the land or have an interest which might be affected by the proposals, can be formally notified of the proposals and included in consultation and engagement going forward. It is important that we are consulting those potentially affected and that they have the opportunity to provide their comments.

We will only use your personal information for the purpose for which we collect it, which includes the following:

  • Making enquiries into land/property ownership and occupation;
  • Consulting with you and others on the Proposed Development and reporting to the Secretary of State, Planning Inspectorate, local authorities or other relevant bodies on the consultation. This may involve the disclosure of your personal data to those parties;
  • To prepare the necessary statutory documents to support the DCO as part of the application for the Proposed Development;
  • Communicating with you and any landowners and occupiers, or those with an interest in the land about the Proposed Development, which may include entering into negotiations with those people;
  • Surveying land and property that may be affected by the Proposed Development;
  • To make sure that those potentially affected by the Proposed Development are notified of the proposals and have an opportunity to provide comments and engage with us in relation to the plans.

We do this on the basis of complying with our legal obligations and government guidance, in particular, the requirements of the Planning Act 2008.

  • Voluntary acquisition and compensation in respect of the relevant land/property, including:
    • communicating with you regarding the possibility of voluntary acquisition of interests in the land/property, including entering negotiations with you to facilitate this and relevant compensation payable;
    • taking steps in order to and entering into relevant legal agreements in respect of the acquisition of your land/property or payment of compensation).

We do this on the basis that it is necessary for our legitimate interests in promoting the DCO application and/or obtaining the relevant land/property for the purposes of carrying out the Proposed Development.

How long do we keep your personal information for?

We will not retain your personal information for longer than necessary for the purposes set out in this privacy notice.  In this case, we will keep your personal data processed in relation to the Proposed Development for the duration of the DCO process including implementation of the DCO should it be granted by the Secretary of State.

When it is no longer necessary to retain your personal information, we will delete or anonymise it.

Who do we share your personal information with?

We may share your personal information with third parties who perform functions on our behalf and who also provide services to us, such as developers, sub-contractors, our service providers, professional advisors and IT consultants. These third parties are required to comply with appropriate privacy and confidentiality obligations.

We will also share your personal information with TerraQuest and other companies we may appoint to act for us in respect of the Proposed Development and for the purposes of the proposed DCO application, such as our agent, Ardent. We will also share your personal information with the Secretary of State, Planning Inspectorate, local authorities or other relevant bodies as part of the DCO application process and consultation as set out above.

Do we transfer your personal information outside the UK?

We may transfer your personal data outside the UK, but only as permitted under the UK protection laws. This is where transfer is to a country the laws of which are deemed by the UK government to have privacy laws that provide an adequate level of protection, or where we have put in place appropriate safeguards to protect your personal data.
